In this case it appears that on the 23rd day of January, 1929, Frances Guy brought an action against her husband, Allen Earl Guy, an incompetent, and his guardian for a divorce, alimony and custody of two minor children, daughters of the parties, and for an allowance for their support.

On June 1, 1929, the court entered a decree granting plaintiff a divorce, awarding her alimony and custody of the minor children and setting apart 40 acres of land belonging to defendant in trust for the use, benefit and support of the minor children until the youngest attained her legal majority, which, under…
