Defendant-Appellant Wabtec Corporation (“Wabtec”) appeals from an order of the United States District Court for the Southern District of New York (Jed S. Rakoff, Judge), denying Wabtec’s motion to dismiss plaintiff-appellee Faiveley Transport Malmo AB (“Faiveley”)’s application for preliminary injunction and expedited discovery. Faiveley cross-moves to dismiss on the ground that this court lacks jurisdiction to hear the appeal.
