— The conceded facts of the case are as follows: One Rosa Weber, being the owner of a hundred *169acre tract of land in Johnson county, Iowa, died testate December 25, 1909. Her will, which has been duly probated, first provides for certain legacies, and then proceeds to dispose of the residue of . her estate in the following manner:

I will devise and bequeath all the rest, residue and remainder of my property after payment of the above legacies, which I may have at the time of my death of whatever kind, nature or description, real, personal or' mixed to be equally divided among my eight children…
