BROWN, Justice.

On December 28, 1940, appellee, Wichita Frozen Food Lockers, Inc., a private cor*783poration, acting by its officer, Alfred R. King, gave a written order to an agent and local representative of appellant, the National Cash Register Company, for a certain cash register to be manufactured for the purchaser specially, so that it would be constructed for use in appellee’s business, which is disclosed to be that of operating frozen food lockers for the public’s use.
