Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Washington County) to review a determination of the Commissioner of Cor rections and Community Supervision which found petitioner guilty of violating certain prison disciplinary rules.

A correction officer observed petitioner, a prison inmate, retrieve an unknown item from a cell. After the officer ordered petitioner to submit to a pat frisk, petitioner attacked the officer and had to be forcibly subdued.
