Plaintiff in error, Willie Boy Batchelor, hereinafter called the defendant, was indicted and tried along with two other men for receiving, possessing, and transporting more than one gallon of liqnor. A jury found the two other men not guilty and acquitted them; and they are not involved in this appeal. Defendant was found guilty and sentenced to serve one year and one day in the penitentiary (T.C.A. sec. 39-2509), and judgment was entered accordingly.
