Before the Court is a motion (the “Motion”) [Docket No. 942] filed by Trico Marine Services, Inc. (the “Debtors”) to determine the validity and priority of a certain make-whole premium (the “Make-Whole Premium”) asserted by Bank of New York Mellon Trust Company, N.A. (the “Indenture Trustee”). Pursuant to an order of this Court approving the sale of certain assets, the Indenture Trustee seeks full and immediate payment of the Make-Whole Premium out of sale proceeds currently held in escrow.
