Robert Schott filed suit against the Santa Fe Railroad for injuries sustained when the automobile he was driving was struck by a Santa Fe train. The train was being operated on railroad tracks belonging to the Belt Railway Company of Chicago (Belt), and it was made a party defendant charged with negligence in the operation and maintenance of the railroad crossing. Robert Schott died from other causes three months before the case was called for trial and his administratrix was substituted as the plaintiff.
