This is an appeal from an order sustaining a demurrer to plaintiff’s evidence in an action to recover for damage to plaintiff’s automobile sustained in an intersection collision with the automobile of defendant.

The petition alleged that at the time of the collision plaintiff’s automobile was being driven by his son Tom and it was framed on the theory that the two automobiles collided as a result of the concurrent negligence of defendant and plaintiff’s son in that defendant’s negligence consisted in not maintaining a proper lookout; not…
