The plaintiff Sussman commenced this action in the superior court, seeking recovery of damages which he claims to have suffered from the failure of the defendant Gustav to deliver to him one hun*276dred tons of scrap iron in compliance with, a contract for the purchase of the iron from the defendant. The cause came regularly on for trial upon the merits and resulted in the court awarding judgment of nonsuit in favor of the defendant at the close of the evidence; introduced in behalf of the plaintiff.
