MEMORANDUM

NEWCOMER, District Judge.

Presently before this Court are defendants’ Motion to Dismiss, and the plaintiffs’ responses thereto. For the following reasons, the Court denies in part and grants in part defendants’ motion.

Also before this Court are Catherine Natsu Lanning, et al.’s Motion for Class Certification, and defendants’ response thereto, and plaintiffs’ reply thereto, and defendants’ reply thereto. In addition, a class certification hearing was held on May 19, 1997, during which the Court heard oral argument in open court in support of and in opposition to plaintiffs' motion.…
