MEMORANDUM AND ORDER
LAKE, District Judge.
Plaintiff, Dr. David .G. Walker, brings this action pursuant to § 21 of the Toxic Substances Control Act (TSCA), 15 U.S.C.A. § 2620, for judicial review of a final decision by the Administrator of the Environmental Protection Agency (EPA) denying plaintiffs petition to initiate a rule-making proceeding aimed at amending the definition of “polychlorinated biphenyls” (PCBs) found at 40 C.F.R. § 761.3.
