Appeal from Monroe Circuit Court. Hon. George W. Beazley, Circuit Judge. A contract must be construed according to the plain and apparent sense thereof. Greenlf. Ev. sec. 278 et scq. There being a subsisting contract at the time, suit must have been brought thereon. 24 Wend. 202; 2 Pick. 275; 9 Ala. 108. “Agreement between John T. Jones and Henry G.
