This action is brought to recover damages for an alleged breach of a contract by defendants to purchase certain merchandise from plaintiff’s assignor. The complaint alleges:
“ Third. That on or about the 9th day of September, 1920, one Louis N. Levinsohn and defendants entered into a certain contract in writing, whereby Louis N. Levinsohn agreed .to sell and deliver to the defendants during the months of October and November, 1920, seven thousand (7,000) dozen number 280 and number 282 men’s soft finished handkerchiefs, and in consideration thereof, the defendants agreed to accept…
