This case involves the sale and delivery of a dozen pairs of shoes ordered by the defendant of the plaintiff by sample or description which the plaintiff delivered to the express company at Boston, Mass., consigned to the defendant at Elmira, N. Y., but which were lost in transit. The plaintiff claims that title to the goods passed to the defendant upon delivery to the express company and that the defendant is liable for the agreed price for the goods with remedy over against the express company for the loss.
