Mr. Judge Slatton,
of the Commission, delivered the opinion for the Court.
Slemons, on June 1, 1939, listed two tracts of land with Hutchings for sale on terms suitable to the owner, and orally promised to pay the broker a five per cent, commission, amounting to $1,649.13. On said date Hutchings informed Slemons that he had a prospective purchaser for the lands in the person of M. L. Johnson.
