Scanlon v. Wedger
Massachusetts Supreme Judicial Court
Tort, for personal injuries occasioned to the plaintiffs by the ■ explosion of a mortar used in a display of fire-works on the evening of September 27, 1888. At the trial in the Superior Court, the jury returned a verdict for the defendant, and Hammond, J. reported the case for the determination of this court. The facts appear in the opinion. The case was argued at the bar in November, 1891, and after-wards was submitted on the briefs to all the judges.

The several plaintiffs were injured by the explosion of a bomb or shell during a display of fireworks in Broadway Square, which was a public highway in Chelsea. This display was made by the defendant Wedger, who acted under a license from the mayor and aldermen of Chelsea for a display of fireworks in Broadway Square on that evening, under Pub. Sts. c. 102, § 55. A verdict was returned for the defendant, and the jury made a special finding that the defendant in firing the bomb exercised reasonable care.
