Bennu’s motion for partial summary judgment is granted. Hombeck’s statutory liens do not constitute Senior Prior Liens. Accordingly, partial judgment will be granted over Bennu’s counterclaim for declaratory judgment that it took the Tele-mark Properties free and clear of Hom-beck’s alleged statutory liens. However, Bennu’s summary judgment motion did not address its request for a permanent injunction.
