Appellee brought this suit against the appellant upon a benefit certificate - issued by it upon the life of Margie Gay, in which the appellee was named as beneficiary.

The certificate is dated July 9, 1917, and Margie Gay paid the assessment thereon until he left in October, 1917. The plaintiff, who was a brother of Margie Gay, was at that time clerk of the local camp at Gadsden, and continued the payments for his brother. At the end of the year 1917, however, he ceased to be clerk of the camp, and was succeeded by one Murphy; the latter being succeeded as clerk in October, 1918. The plaintiff…
