LIGHTFOOT, Chief Justice.
Appellant's statement of the case is substantially correct, and is adopted, as follows: “This suit was brought July 3, 1893, by appellee, J. C. Russell, they and now a resident of the State of Arkansas, against the appellant, Western Union Telegranh Company, to recover damages for negligence in transmitting and delivering a message, filed August 23, 1892, at Garland, Miller County, Arkansas, addressed to Drs. Henry or Bright, New Lewisville, Arkansas, reading: ‘Come to my place at once.’ Signed by J. C. Russell.
