This is an appeal by plaintiff below from a judgment rendered in favor of defendant and against the plaintiff dismissing the action with prejudice and on the merits.

Appellant First National Bank of Logan commenced this action against respondent, Walker Bank and Trust Company, in the District Court in and for Cache County, State of Utah, seeking:(1) A declaratory judgment that the com struction of certain new banking facilities by respondent in Logan, Utah, was in violation of Section 7-3-6, UCA 1953, as amended, and (2) an injunction restraining respondent from operating…
