BROWN, Justice.

This is an original petition for the issuance of the writ of mandamus by this Court addressed to the Hon. J. S. Williams, Judge of the Circúit Court of Dale County, commanding him to vacate an order of the court refusing the petitioners’ motion to strike the demand of the defendant for trial by jury on the issue vel non of the relation of employer and employee between the defendant and the alleged deceased workman in a proceeding under the Workmen’s Compensation Law. Code 1940, Tit. 26, § 253 efc seq.
