MANSFIELD, District Judge.

In this diversity libel action brought by Jess Stearn, the author of the book The Search for the Girl with the Blue Eyes, against a Canadian publishing company whose magazine MA-CLEANS contained in its May 1968 issue an article concerning plaintiff and his activities in connection with the writing of the book, defendant moves pursuant to Rule 12(b) (6), F.R.Civ.P., for dismissal of the complaint on the ground that it fails to state a claim on which relief can be granted.
