— In an action to recover damages for breach of contract, the defendant Harry Ostreicher appeals from so much of an order of the Supreme Court, Nassau County (Murphy, J.), dated July 11, 1985, as denied his motion for summary judgment dismissing the complaint as against him.

Order reversed insofar as appealed from, on the law, with costs, motion granted, and complaint dismissed as against the defendant Ostreicher.
