On January 14, 1988, Robert Earl Kirsch (“Kirsch”), the debtor, petitioned the United States Bankruptcy Court for the Eastern District of Virginia, Newport News Division, for relief under Chapter 7 of the Bankruptcy Code. Vivian Jones (“Jones”), one of two creditors listed in Kirsch’s schedules, filed an objection to Kirsch’s claim of a homestead exemption under the Code of Virginia 34-4 (1984) (“Virginia Code”).
