Plaintiff KML Laboratories Limited (“KML”) has moved, pursuant to Fed. R.Civ.P. 56, for summary judgment on its rescission and breach of contract claims and for dismissal of the counterclaims by defendants Robert A Hopper, Jill S. Schneider, and Thomas P. Tobin (“Hopper Group”). Defendants have cross-moved for summary judgment against KML, certain KML officials, and an affiliated biomedical waste disposal company, Decom Medical Waste Systerns, Inc.
