ROB RENO, District Judge.
Eileen Guckin (“Guckin”) and her husband Stephen Guckin brought this personal injury action against defendants Dr. Deborah Nagle, Tenet Healthcare Corporation, Graduate Hospital; Curon Medical, Inc. (“Curon”), and several John Does in state court claiming that she was injured in the course of her participation in the clinical trial of an investigational medical device designed to remedy fecal incontinence.
