DECISION & ORDER

C. ALBERT PARENTE, Bankruptcy Judge.

Debtor, Emil Paul Klein, moves this court for an order dismissing his Chapter 7 case.

BACKGROUND

On April 22, 1982, debtor filed a petition under Chapter 13 of the Bankruptcy Reform Act of 1978 (“Code”). Thereafter, the debtor moved ex parte to convert the ease to one under Chapter 7 pursuant to 11 U.S.C. § 1307.
