There are two judgments in this action, and an appeal is taken from each. The amended complaint stated two causes of action. The first was to foreclose a mechanic’s hen on a public improvement. The second was a cause of action against the defendant Tarrytown National Bank & Trust Co. for alleged diversion to it of moneys received by the contractor under the contract. The relief demanded on this cause of action was an accounting. Eleven of the defendant lienors served answers containing counter*214claims against the bank, similar to the second cause of action in the amended complaint.
