MEMORANDUM OPINION

This matter was tried on May 11, 2009. Pursuant to Rule 52(a) of the Federal Rules of Civil Procedure, the Court now enters its findings of fact and conclusions of law.
I. FINDINGS OF FACT
At all times relevant to this action, Stephen McCauley (“McCauley”) was a student at the University of the Virgin Islands (“UVI,” or the “University”). Sean Georges (“Georges”) is the director of student housing at UVI. At all times relevant hereto, Dr. LaVeme E. Ragster (“Ragster”), was the president of the University.
