On the 14th day of December, 1887, the appellee, acting for himself and the other heirs of Jonas *503Huntington, deceased, entered into a contract witli Frank E. Little and Lawrence H. Wilson, according to the terms of which Little and Wilson were to purchase of appellee about two hundred acres of land, situated on Wayzata Bay, Lake Minnetonka, in the State of Minnesota, for the sum of fifty thousand dollars.
