MEMORANDUM OPINION AND ORDER

HADEN, Chief Judge.

Pending are eight motions for summary judgment. 1 Defendants USX Corporation and U.S. Steel Mining Co. (collectively “USX”) filed four motions for summary judgment. 2 Plaintiff Carbon Fuel Co. (“Carbon Fuel”), and Third-Party Defendants Consolidation Coal Co. (“Consol”), Old Ben Coal Co. (“Old Ben”), and Arch Mineral Corp. and Arch of Kentucky (collectively “Arch”) have each filed one motion for summary judgment.
