This case originated in the justice of the peace court of John F. Howard, justice of the peace in District No. 1 of Harrison County. Daniel D. Guice, as agent and attorney for Mrs. W. C. Palmer, filed an affidavit with the justice of the peace on April 3, 1952, in which it was alleged that James W.
