Appeal from a judgment of the superior court for Spokane county, Sullivan, J., entered March 15, 1915, upon the verdict of a jury rendered in favor of the plaintiff, in an action for personal injuries.

The purpose of this action was to recover damages for personal injuries, alleged to be chargeable to the negligence of the defendant. The plaintiff, at the time of the accident, was a little girl, approximately eight years old, and brings the action by her guardian ad litem. The trial of the cause resulted in a verdict in favor of the plaintiff for the sum of $4,000. Motion for a new trial being made and presented, the trial court entered an order directing that the plaintiff elect to remit $1,000 from the amount of the verdict, and if this were not done, a new trial would be ordered.…
