Action of tort in which a pedestrian, while crossing the highway in the month of August, was struck and injured by a piece of flying ice thrown by the wheel of a passing automobile. The employees of the defendant, operating the defendant’s ice truck, had passed by the place where the plaintiff was injured, shortly before the plaintiff was struck, and, in their passage, three buckets of chopped ice had fallen from the truck to the highway.
