MEMORANDUM DECISION GRANTING MOTION FOR RELIEF FROM AUTOMATIC STAY

The Debtor’s landlord seeks relief from the automatic stay to continue pre-petition eviction proceedings commenced against the Debtor in the Civil Court of New York. While the parties’ submissions raise interesting questions of law as to whether the landlord can evict the Debtor — at least under the existing warrant of eviction — these issues involve state law, and can be decided by a state court judge.
