Appeal from special term, New York county. Application by Henry H. Lyman to revoke the liquor-tax certificate , granted to the Young Men’s Cosmopolitan Club of New York. From an order denying the application, petitioner appeals. Reversed.

On the 26th of April, 1897, there was presented to the special deputy commissioner of excise for the county of New York an application of the Young Men’s Cosmopolitan Club of New York, by Charles Smith, its president, for a liquor-tax certificate, under the provisions of the liquor-tax law (chapter 112, Laws 1896). Upon that application, which was in proper form, a liquor-tax certificate was granted. On the áth of June, 1897, a petition was presented to this court by Mr. Lyman, the state commissioner of excise, asking, for an order revoking and canceling the certificate which had been granted…
