Plaintiff Tillman brought this action against defendant Lincoln Warehouse Corporation (Lincoln) for its failure to return a substantial portion of the Tillman collection (the "collection”). He sought recovery from defendant Transamerica Insurance Company (Transamerica) on an "all risks fine arts” policy. At the end of plaintiffs case, the trial court granted Lincoln’s motion to dismiss the action as against it on the ground that the plaintiff had not proved the collection was placed in Lincoln’s warehouse.
