At issue in this Espionage Act 1 prosecution is the government’s second motion pursuant to § 6(c) of the Classified Information Procedures Act (CIPA), 18 U.S.C.App. 3, to introduce certain summaries, redactions, and substitutions at trial in lieu of certain specific classified information, and to use the “silent witness rule” (SWR) with respect to portions of certain documents and recordings.
