In an information filed against defendant, August H. Gensmer, Jr., he was charged with a violation of M. S. A. 613.05, which covers the offense of asking and agreeing to receive a. bribe. Defendant was a member of the board of county commissioners of *74Winona county. The information charges that defendant, while a member of the county board, asked and agreed to receive $300 as a bribe from one John W.
