This appeal follows the December 13,2006 decision of the Workers’ Compensation Commission (Commission) that reversed the June 29, 2006 opinion of the Administrative Law Judge (ALJ), finding specifically that appellant Leslie Toia failed to prove by a preponderance of the evidence that he was performing employment services at the time his injuries occurred. On appeal, appellant challenges the Commission’s decision on that single issue. We reverse and remand for an award of benefits.
