After a trial by jury defendant was found guilty of criminal possession of a weapon in the first degree. This offense was committed on August 28, 1980. The People filed a statement pursuant to CPL 400.16 alleging that defendant was a persistent violent felony offender. After a preliminary examination and hearing I have determined that the defendant was convicted on May 23, 1973 of robbery in the second degree, a class C felony, and was convicted on May 14, 1976 of criminal possession of a weapon in the third degree, a class D felony.1 It is the…
