MEMORANDUM OPINION

REGGIE B. WALTON, District Judge.

This matter is before the Court on a motion to dismiss filed on behalf of the Commissioner of Social Security (“Commissioner”). 1 For the reasons discussed below, the motion will be granted.

I. BACKGROUND
