McLELLAN, District Judge.
This suit involves infringement of the copyrights on two popular songs. The plaintiffs are Gene Buck, as President of the American Society of Composers, Authors, and Publishers, Joe Davis, Inc., and Leo Feist, Inc. The Society is an unincorporated association, made up of composers, authors and their publishers, whose purpose is to protect the rights of its members in public performances of works secured by copyrights held by them.
