MEMORANDUM OPINION AND ORDER

FORESTER, District Judge.

I. Introduction

Currently pending before the Court is the United States’ motion for summary judgment. By agreement of the parties, the Court ordered that this action be held in abeyance pending the disposition of this motion. The motion having been fully briefed, it is ripe for review.

II. Background

This litigation stems from the November 9, 1991, shooting in which Robert Daigneau (“Daigneau”) shot and killed four of the six occupants of a 1991 Lincoln Continental owned and operated by Fred Marion Alsman before killing himself. Those killed…
