This cause is here on appeal from a final decree dismissing a bill for specific performance by the appellees, of two written contracts to purchase land which had been executed by the appellants as vendors and by “John W. Gunby, as trustee.” The contracts provided for the conveyance of a designated percentage of certain lands whose titles were or could be made in a designated time, marketable, and contained provisions contemplating the quieting by suit of the titles of the remaining lands, to be followed by the conveyances of those lands.
