Johnnie O’Neal brings this action against the City of New York (the “City”), the New York City Housing Authority (“NYCHA”), and Jose Morales, alleging violations of his rights under 42 U.S.C. § 1983. O’Neal was arrested and convicted in 1985 of rape in the first degree in violation of New York Penal Law § 130.35 and robbery in the first degree in violation of New York Penal Law § 160.15.
