Order, Supreme Court, New York County (Carmen Beauchamp Ciparick, J.), entered August 2, 1990, which denied the defendant’s motion for summary judgment dismissing the complaint and for judgment on his counterclaim, unanimously reversed, on the law, the defendant’s motion for summary judgment is granted, the complaint is dismissed, judgment is awarded on the defendant’s counterclaim, and the matter is remitted to the Supreme Court for an assessment of reasonable attorneys’ fees to be awarded the defendant, with costs.
