Plaintiff is appealing from a judgment of the District Court rejecting his demand for $700.00 claimed to be due him as commission on the sale of real estate in the city of Monroe.

The pleadings and the evidence in the record disclose that on May 13, 1946, defendant signed a regular form of agreement listing the property with plaintiff for sale under an exclusive contract for a period of thirty days.
