The parties will be referred to as plaintiff and defendant, according to their position in the lower court. This action was filed in the district court of Cotton county by the plaintiff, Otto Coley, to recover 75 acres of matured wheat, the petition being in the usual form, alleging that the plaintiff is the owner and entitled to immediate possession, and fixing the value at $1,500.
